Delivery of the Goods
8.1 Delivery terms and prices are indicated on flowerauctions.net, in the description of each good.
8.2 When ordering goods, the Buyer may choose one of the delivery methods:
8.2.1. delivery by courier and/or by the Seller or its authorized person;
8.2.2. the Buyer may collect the goods free of charge from “Flowerswave” B.V. shop.
8.3 If the Buyer chooses the home delivery service at the time of order:
8.3.1. the Buyer undertakes to specify the exact place (address) of delivery;
8.3.2. the Buyer undertakes to collect the goods himself. A valid proof of identity (identity card, passport or new driving license) must be presented at the time of collection. If the Buyer is unable to accept the goods himself/herself and the goods have been delivered to the address indicated by the Buyer, the Buyer shall not be entitled to claim against the Seller for delivery of the goods to the wrong person.
8.3.3 The home delivery service fee does not include the delivery of the ordered goods to any floor, which the Buyer may order additionally.
8.4 If the Buyer chooses to collect the goods free of charge from “Flowerswave” B.V. shop:
8.4.1. the ordered goods must be collected no later than within 3 (three) calendar days after the Seller has informed the Buyer by e-mail that the goods are available for collection.
8.4.2 The goods may only be collected by the person who placed the order or by the person specified at the time of placing the order. When collecting the goods, it is necessary to present a valid document of identification (identity card, passport or new driving license) to an employee of the Seller.
8.5 The Seller shall deliver the goods to the Buyer in accordance with the terms set out in the descriptions of the goods. These deadlines are provisional and do not apply in cases where the Seller does not have the goods in stock and the Buyer is informed of a shortage of the goods ordered.
8.6 By accepting the Rules, the Buyer agrees that in exceptional circumstances the delivery of the goods may be delayed due to unforeseen circumstances beyond the control of the Seller. In such case the Seller undertakes to contact the Buyer immediately to agree the terms and conditions of delivery. If the Seller fails to deliver the goods within the additional time limit, the Buyer may exercise the right set out in Clause 10.1 of the Rules and to withdraw from the contract for the sale of goods or services.
8.7 The Seller is released from liability for violation of the terms of delivery of the goods if the goods are not delivered to the Buyer, or are not delivered on time due to the fault of third parties or due to circumstances and/or fault of the Buyer.
8.8 At the time of delivery of the goods to the Buyer, the Buyer shall inspect the condition of the package and the good(s) together with the Seller or its authorized representative and sign the consignment acceptance document. Once the Buyer has signed the acceptance document, it is considered that the goods have been delivered in a proper condition and there are no violations, the cause of which is attributable to non-factory defects and discrepancies in the product (s) (such as those which can be detected by an external inspection of the goods). If the Buyer notices that the packaging of the delivered goods is damaged (crumpled, wet or otherwise externally damaged), the goods(s) are damaged and/or the goods(s) are not in the correct condition, the Buyer shall note this in the acceptance document and, in the presence of the Seller or his representative, shall draw up a free-form certificate of the damage/non-compliance of the consignment and/or of the good(s). If the Buyer fails to do so, the Seller shall be released from liability for damage to the goods when the cause of such damage is not a factory defect and for discrepancies in the assembly of goods only if these discrepancies can be identified during the external inspection of the goods.
8.9 The risk of accidental loss or damage to the goods shall pass to the Buyer from the moment the goods are handed over to the Buyer.
8.10. If, in accordance with Clauses 8.3 to 8.4 of the Rules, the Buyer fails to collect the goods within the set time limit or fails to accept the delivery of the goods and the Buyer has paid for the goods and their delivery, the courier, the Seller or its authorized person shall contact the Buyer to arrange another time and/or method of delivery. If the Buyer still does not collect the goods or fails to accept the delivery of the goods, such goods shall be returned to the Seller, the order shall be cancelled and the Buyer shall be refunded the money paid for the goods, minus any bank charges applicable to the Seller for the bank transfers made, the delivery charge, if applicable, and the administration fee of 5 EUR if applicable.
8.11 If, in accordance with Clauses 8.3 to 8.4 of the Rules, the Buyer fails to collect the goods within the set time limit or fails to accept the delivery of the goods and the Buyer has not paid for the goods, such goods shall be returned to the Seller and the order shall be cancelled.
